Loyalty program regulations

1.1. These Regulations establish the conditions and rules for the participation of individuals in the Privilege Program of the Vremena Goda Galleries and represent accordance with Article 437 of the Civil Code of the Russian Federation, a public offer for their participation in the Vremena Goda Galleries Privilege Program.

1.2. An individual above the age 18 years who agrees with the terms of the offer set forth in these Regulations has the opportunity to conclude an agreement on participation in the Privilege Program of the Vremena Goda Galleries (hereinafter referred to as the “Agreement”). At the same time, in accordance with article 3, paragraph 438 of the Civil Code of the Russian Federation, in order to conclude an Agreement with the specified person on the conditions set forth in this public offer, it is necessary and sufficient for the specified person to fill out and sign the Application Form for the Participant of the Privilege Program of the Vremena Goda Galleries as specified in article 1.3. of these Regulations.

1.3. In this public offer, the following terms have the following meanings

"Shopping center", "Galleries" Vremena Goda" - multifunctional shopping center" Vremena Goda ", located at: Moscow, Kutuzovsky prospect, 48.

"Acceptance" - full and unconditional acceptance by an individual of the terms of this public offer and their willingness to become a Participant of the Privilege Program of the Vremena Goda Galleries.

"Mobile application" - a software product required to provide the Vremena Goda Galleries Privilege Program Participant with all services provided by the Vremena Goda Galleries Privilege Program and posted in the public domain on Google Play and the App Store for free use on mobile devices on iOS and Android platforms.

"Questionnaire of the Participant of the Privilege Program of the "Galleries" Vremena Goda" (hereinafter the "Questionnaire") - the survey form of the Participant of the Privilege Program of Galleries" Vremena Goda ", including, among other things, the personal data of the Participant of the Privilege Program of "Galleries" Vremena Goda ", personally signed by the Participant of the Privilege Program Vremena Goda Galleries upon receipt of a Privilege Program card.

Signing of the Questionnaire can also be done through the Mobile Application of the Privilege Program of the Vremena Goda Galleries by filling out the appropriate form.

Signing of the Questionnaire by the Participant of the Privilege Program of the Vremena Goda Galleries by any of the ways specified means that the Participant of the Privilege Program of the Vremena Goda Galleries gives consent to the processing of their personal data in order to participate in the Vremena Goda Galleries Privilege Program.

"Owner" - OCTAN PLUS ALFA LLC (OGRN 1037743006432), which develops and manages the Shopping Center and is the organizer of the Program.

"Personal data" - any information relating directly or indirectly to a specific or identifiable individual (subject of personal data).

Processing of personal data of the Vremena Goda Galleries Privilege Program Participants - any action (operation) or a set of actions (operations) performed by OCTAN PLUS ALFA LLC with personal data of the Vremena Goda Galleries Privilege Program Participants using automation tools or without using such means, namely (article 3 paragraph 3 of Law No. 152-FZ):

• collection, recording, systematization;
• accumulation, storage;
• clarification (update, change), extraction;
• use, transmission (distribution, provision, access);
• depersonalization, blocking, deletion, destruction of personal data.

“Card of the Participant of the Privilege Program of the Vremena Goda Galleries”, “Card” - a plastic card or an electronic card with a unique number allowing identification of the Participant of the Privilege Program of the Vremena Goda Galleries when making a payment throughout the Shopping Center. The card is activated and used when paying for goods or services at the shops of the Vremena Goda Galleries. The card is not a means of payment.

“Account in the Privilege Program of the Vremena Goda Galleries”, “Account” - a set of credentials and information about the Program Participant, the amount of their payments in the retail outlets of the tenants of the Shopping Center and available discounts in percentage terms.

"Abuse of rights" – unjust acts of the Program Participant aimed at accumulating the maximum amount of payments on the account without actually making payments throughout the Shopping Center.

Program Operator - Manzana Soft LLC (M Soft LLC), which provides technical, organizational and informational support as well as Program support.

"Goods" – an item or several goods purchased or available for purchase in any of the legal entities located in the Shopping Center. For the purposes of this agreement, the term "Goods" also means the services purchased by the Program Participants and their results provided by any legal entity or individual entrepreneur located in the Shopping Center.

"Participant of the Program" - an individual (intending to order or purchase, or ordering, purchasing or using the purchased Goods exclusively for personal, family, household and other needs not related to business activities) over 18 years old, who has expressed their intention to participate in the Program in accordance with these Regulations. By becoming a Participant of the Program, an individual expresses unconditional consent to the Program Regulations, as well as to receive advertising, marketing and other information materials in whatever form (SMS mailing, e-mail, etc.).

2. Subject of the public offer

2.1. When making a purchase in the Shopping Center, an individual over 18 years is offered to become a Participant of the Program, accumulate the amount of purchases in their account and receive a discount on purchases at some retail outlets located in the shopping center under the terms of this public offer. To participate in the Program, it is mandatory to fill out the Questionnaire with the subsequent registration of the personal data by the representatives of the Seller in the Program database.

3. Principal terms of the public offer

3.1. This public offer defines the conditions and procedure for Program participation.

3.2. Only individuals over 18 years old - "Program Participants" can take part in the Program.

3.3. An individual meeting the requirements for the Participant of the Program joins the Program by filling out and signing the Questionnaire with any of those specified in the article 1.3. Regulation means;

3.4. By performing the actions specified in article 3.3. of these Regulations and aimed at joining the Program, the Program Participant, thus, confirms that they have read this public offer, fully and unconditionally accept the terms of participation in the Program, as well as agree with them and are committed to respect.

3.5. Within the framework of the Program, the Participants of the Program accumulate points, expressed as the amount of payments made at any outlet throughout the Shopping Center on their account, which, in accordance with the terms of section 4 of these Regulations, allows them to use a certain discount, receive a bonus or privilege when making subsequent purchases in the outlets specified by the Program in the Shopping Center.

3.6. When a discount on purchases to all customers is provided at a point of sale throughout the Shopping Center, different from the discount provided to the Participant of the Program, these discounts are not cumulative and a larger discount is valid for the Program Participant.

3.7. Discounts on purchases provided to the Participants of the Program for various promotions are not summable. If a product or service is involved in several promotions, a larger discount is valid for the Participant of the Program.

3.8. The discount provided to the Participant of the Program does not apply to products from the "Sale" group.

3.9. These Regulations of the Program are officially published on the Seller's website https://vremenagoda-moscow.ru/

3.10. In order to confirm payment, the Participant of the Program has the right to provide the Seller with documents confirming the payment.

4. The procedure for assigning statuses to the Cards of the Participants of the Program.

4.1. The Program Operator accepts for crediting to the account of the Participant of the Program all payments in sales outlets located in the Shopping Center, made upon presentation of the Card at the checkout of the sales point, which is the basis for obtaining the privileges specified in this section. Also, when accumulating the amount of purchases, it is possible to identify the Program Participant by the phone number indicated in the Questionnaire.

4.2. Until the Participant makes purchases in the amount of 300,000 (Three hundred thousand) rubles, the Card operates in the SPRING status.

4.3. If the Participant of the Program makes payments for goods and services in the Shopping Center for an amount exceeding 300,000 (Three hundred thousand) rubles within one calendar year from the date of such an excess of the specified amount, their Card is assigned the SUMMER status.

4.3.1. The Card with the SUMMER status is subject to the following privileges at the points of sale of the Shopping Center:

4.4. If the Participant of the Program makes payments for goods and services in the Shopping Center for an amount exceeding 1,000,000 (One million) rubles within one calendar year from the date of such excess, the Card is assigned the AUTUMN status.

4.4.1. The following privileges apply to the Card with the AUTUMN status:

4.5. If the Participant of the Program makes payments for goods and services in the Shopping Center in the amount of more than 3,000,000 (Three million) rubles within one calendar year from the date of such excess, his Card is assigned the WINTER status.

4.5.1. The following privileges apply to the Card with the WINTER status:

4.6. The status of the Program Participant's Card must be automatically confirmed annually in accordance with the above conditions. The condition for confirming the status is making payments for the amount indicated in the status within one calendar year from the date of achieving the status. If the Participant of the Program has not confirmed their status within a year, it can be downgraded to the level corresponding to the amount of purchases made in the Shopping Center during the year.

4.7. The Owner has the right to suspend the provision of discounts, bonuses, privileges by blocking the Card for the period of considering the situation for the discretion in the actions of the Participant of the Program abuse of rights, fraud and/or violation of this offer and/or abuse of privileges and/or incentives provided to the Participants of the Program.

4.8. In addition to the grounds listed in article 4.1. of this public offer, within the framework of the Program there may be special promotions, under the terms of which Participants of the Program may be provided with additional discounts for completing additional actions: purchases on a birthday, attracting new participants to the program, etc.

4.9. If for technical reasons the use of the Program Participant's Card is impossible, the Owner reserves the right to refuse the Participant of the Program to carry out the operation until the malfunction is corrected.

4.10. The Participant of the Program has the opportunity to use the Card for the passage (exit) to the parking area of the Shopping Center, as well as to identification as a Participant of the Program for paying for parking.

4.11. For passage (exit) to the parking of the Shopping Center, you must tap the Card to the card collector of the barrier at the entrance/exit from the territory of the Shopping Center.

4.12. If you use the Card to identify yourself as the Participant of the Program to pay for parking, you must use the “Parking” service in the Mobile Application and pay with a credit card or use a parking meter on the territory of the Shopping Center to pay.

4.13. The recipient of the funds paid as a fee for parking on the territory of the Shopping Center is the Limited Liability Company “R.D. Management Services "(OGRN 1027739784016).

4.14. In case of a funds refund paid by a bank card and received for paying for parking, these funds are to be returned to the Participant of the Program to the same bank card with which the payment was charged.

5. Information about the account balance:

5.1. The Participant of the Program has the right to receive information about the status of their Account. To obtain information about the status of their Account, the Participant of the Program can use the following means:

• send a request through the feedback form on the Seller's website or by sending a request through the feedback form in the mobile application,
• check the information in the mobile application,
• install an electronic duplicate of the Card on your mobile device,
• contact the information desk of the Vremena Goda Galleries for information.

6. Restoring the balance of the card.

6.1. The Participant of the Program has the right to restore the balance of the Card in case of its loss. To do this, they must go through identification and fill out an application for replacing the Card, by indicating the mobile phone number.

If the provided phone number coincides with the number that is already registered in the Program, the balance of the lost Card will be transferred to a new one with confirmation of the number by SMS, and the lost card will be blocked without the possibility of recovery.

6.2. The Participant of the Program has the right to combine the balances of several Cards registered in their name, in case they have any, for which the following actions must be performed:

• fill out an application for the consolidation of card balances

If the data specified in the application coincides with the Application Form of the Participant of the Program, the balance of his Card (s) will be transferred to the Card specified in the application, with subsequent blocking of the zeroed Card (s) without the possibility of their restoration.

7. Return of goods.

7.1. Warranty service, exchange and return of the Goods purchased using the Card are carried out according to the manner specified by the current legislation of the Russian Federation.

7.2. The amounts of all purchases in respect of which a refund is made in stores located in the Shopping Center are excluded (cancelled) from the amount of purchases made, on the basis of which the status of the Program Participant's Card is determined.

8. Rights and obligations of the Parties.

8.1. The Program Operator is not responsible for disputes and disagreements arising between the Participant of the Program and the Owner unless such disputes and disagreements are caused by the Program Operator's violation of its obligations under the Program.

8.2. The Program Operator is responsible to the Owner and/or the Participant of the Program for the completeness and correctness of accounting for the amounts of all purchases of the respective Participant of the Program.

8.3. The Owner has the right to make changes and additions to these Regulations and the Program. In case of a change in the Program Regulations, the Owner notifies the Program Operator and the Participant of the Program no later than 3 (three) calendar days before the effective date of the new edition by posting an electronic version of the new edition of the Regulations on its website.

8.4. The Participant of the Program undertakes to independently monitor changes and additions to this Program.

8.5. The Owner has the right to unilaterally suspend or terminate the implementation of the Program at any time at its discretion. Information about the suspension or termination of the implementation of the Program is communicated to the Program Operator and the Participant of the Program at least 45 (forty five) calendar days prior to the expected date of suspension or termination of the Program by posting relevant information on the Seller's website specified in article 3.6 of these Rules.

8.6. During the period when the implementation of the Program will be suspended (in case of suspension of the Program), as well as from the date of termination of the implementation of the Program (in case of termination of the implementation of the Program), the Operator does not record payments and also suspends/terminates the fulfilment of its obligations under this Program with the exception of obligations to preserve information about payments already made by the Participants as of this date and other confidential information.

8.7. From the date of termination of the Program, the Program Operator closes all Accounts, while the Operator and/or the Owner does not make any payments and/or compensation in favor of the Participant of the Program.

8.8. In case the Owner and / or the Program Operator are forced to suspend the Program due to circumstances beyond their control (force majeure), the Participants of the Program are notified of such suspension at any reasonable time, while the provisions on the notice period provided for in article 8.5. are not applied.

9. Confidentiality and protection of personal data.

9.1. The Participant of the Program provides the Owner with their personal data and agrees to the processing of personal data of the Vremena Goda Galleries Privilege Program Participants, including their collection, processing, systematization, updating, use and storage in order to implement the program.

9.2. The Owner undertakes not to disclose the information received from the Participant of the Program. It is not considered a violation for the organizer to provide information to agents and third parties acting on the basis of an agreement with the Owner to fulfill obligations to the Participant of the Program.

9.3. Disclosure of information in accordance with the reasonable and applicable requirements of the current legislation of the Russian Federation is not considered a violation of the non-disclosure obligation.

9.4. The Participant of the Program agrees to receive informational messages from the Seller via SMS, push notifications or e-mail containing information about the Program, including the status of registration in the Program, account status, card status, the possibility of obtaining an electronic duplicate of the card, etc.

9.5. The Participant of the Program separately, when filling out the Questionnaire, agrees to receive marketing messages from the Seller about various events, bonuses, promotions and discounts. The Participant of the Program has the right to change the settings for receiving these messages from the Seller by contacting the call-center or the information desk of the Vremena Goda Galleries.

9.6. If the Participant of the Program does not want their personal data to be processed in the future, they can inform the Seller about this by contacting the call-center or the information desk of the Vremena Goda Galleries. After the Participant is identified, the information previously received from them will be deleted from the Program database, and their Card is blocked. Subsequent use of the Card will be impossible.
